1. Agreement to Terms

By accessing and using Editoya ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Editoya is a product of Softadom, a software development company. These terms govern your use of our image editing platform.

2. Description of Service

Editoya provides AI-powered image editing services including but not limited to:

Background removal using artificial intelligence
Image resizing and cropping with smart aspect ratio preservation
Image compression with quality control
Watermark addition with customizable positioning and opacity
Template management and storage

3. User Accounts

3.1 Account Creation

To use our services, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account
You must provide accurate and up-to-date information
You are responsible for maintaining the security of your password

4. Acceptable Use Policy

4.1 Permitted Uses

You may use our service for lawful purposes only, including:

Personal image editing and enhancement
Business and commercial image processing
Educational and research purposes
Creative and artistic projects

4.2 Prohibited Uses

You agree not to use our service for:

Uploading or processing illegal, harmful, or offensive content
Violating any applicable laws or regulations
Infringing on intellectual property rights of others
Attempting to gain unauthorized access to our systems
Interfering with or disrupting our service
Creating fake accounts or impersonating others
Spamming or sending unsolicited communications
Processing images containing malware or malicious code

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of all images and content you upload to our service. By uploading content, you grant us a limited license to process, store, and deliver your content as necessary to provide our services.

5.2 Our Content

All content, features, and functionality of Editoya, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are owned by Softadom and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.3 Processed Results

You own the processed results of your images. However, you may not use our service to create content that infringes on the rights of others or violates these terms.

6. Payment Terms

6.1 Subscription Plans

Free Plan: 3 edits total with watermarks
Pro Plan: $9/month for unlimited edits without watermarks
Pay-per-download: $1 per processed image download

6.2 Billing and Payments

Subscriptions are billed in advance on a monthly basis
All payments are processed securely through Stripe
Prices are subject to change with 30 days' notice
No refunds for partial months or unused services

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to Pro features until the end of your paid period.

7. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may temporarily suspend the service for maintenance, updates, or technical issues. We are not liable for any downtime or service interruptions.

8. Data Storage and Retention

Original Images: Stored securely and never modified
Processed Images: Retained for 30 days (free users) / 90 days (Pro users)
Account Data: Retained until account deletion
Usage Data: Retained for up to 2 years for analytics

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using our service, you agree to the collection and use of information in accordance with our Privacy Policy.

10. Disclaimers and Limitations

10.1 Service Disclaimer

Our service is provided "as is" without warranties of any kind. We do not guarantee that our AI processing will be 100% accurate or that the service will meet your specific requirements.

10.2 Limitation of Liability

To the maximum extent permitted by law, Softadom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

11. Indemnification

You agree to defend, indemnify, and hold harmless Softadom and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the service or violation of these terms.

12. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will cease immediately.

13. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction where Softadom is incorporated, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of that jurisdiction.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the service after such modifications constitutes acceptance of the updated terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
